Terms and Conditions

1. The seller

The online shop at https://pottery-store.com is operated by:

2. Definitions

  1. Seller — the entity identified in section 1.
  2. Customer — any person or entity entering into a Sales Contract with the Seller.
  3. Consumer — a natural person acting for purposes outside their trade, business, craft or profession.
  4. Goods — the movable items offered in the Shop.
  5. Sales Contract — a distance contract concluded between the Customer and the Seller.

3. Orders and conclusion of the contract

  1. Orders may be placed at any time, with or without a customer account.
  2. Product information in the Shop is an invitation to treat, not a binding offer.
  3. An order is placed by adding Goods to the basket, selecting delivery and payment methods, and confirming with the button marked "Order with obligation to pay". Clicking this button places you under an obligation to pay.
  4. Immediately before you place the order we show you a summary containing the description of the Goods, the total price including taxes, delivery costs and the delivery details.
  5. The Sales Contract is concluded when you receive our e-mail confirming that the order has been accepted for processing. An automatic acknowledgement of receipt is not yet an acceptance of your offer.
  6. We record the contract and make it available to you in the confirmation e-mail, together with these Terms and the information on the right of withdrawal.

4. Prices and payment

  1. All prices shown are gross prices and include value added tax.
  2. For deliveries to European Union countries, VAT is charged at the rate applicable in the country of delivery under the One Stop Shop scheme. The gross price shown in the Shop does not change depending on the country of delivery.
  3. Prices do not include delivery costs, which are shown separately before you place the order.
  4. Available payment methods are shown during checkout.
  5. Where payment in advance is required and payment is not received within 7 days of the conclusion of the contract, we may withdraw from the contract after first asking you to pay.

5. Delivery

  1. Delivery methods and costs are shown before you place the order and depend on the weight of the parcel and the country of delivery.
  2. The delivery period runs from the date the payment is credited or, for payment on delivery, from the conclusion of the contract.
  3. The Goods are fragile. We pack parcels so as to protect them in transit. We recommend checking the parcel on delivery; a damage report drawn up with the carrier makes a claim easier to pursue, but it is not a condition of a claim or of your statutory rights.
  4. For Consumers, the risk of loss of or damage to the Goods passes to you when you take physical possession of the Goods.

6. Right of withdrawal

  1. If you are a Consumer, you have the right to withdraw from the contract within 14 days without giving any reason and without incurring any costs other than those stated below.
  2. The full statutory information on withdrawal, and a model withdrawal form, are set out at the end of these Terms. Using the form is not obligatory.
  3. You will have to bear the direct cost of returning the goods.
  4. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
  5. The right of withdrawal does not apply to goods made to your specifications or clearly personalised — this covers items decorated to individual order.

7. Conformity of the goods (complaints)

  1. We are obliged to deliver goods that are in conformity with the contract.
  2. We are liable for any lack of conformity which exists at the time of delivery and becomes apparent within two years of that time. A lack of conformity becoming apparent within that period is presumed to have existed at the time of delivery.
  3. Where goods are not in conformity, you are first entitled to have them repaired or replaced. If repair and replacement are impossible or disproportionate, or if we fail to complete them within a reasonable time or refuse to do so, you are entitled to a price reduction or to terminate the contract.
  4. You are not entitled to terminate the contract if the lack of conformity is only minor.
  5. Please send complaints to shop@pottery-store.com or in writing to the Seller's address, describing the defect, when you noticed it and what remedy you are seeking.
  6. We will respond to your complaint within 14 days of receiving it.
  7. We bear the costs of repair or replacement, including the cost of shipping.
  8. Each piece is hand-decorated, so minor variations in pattern, shade and dimensions against the photos and other pieces are a characteristic of the Goods described in the Shop, resulting from their handmade nature, and do not constitute a lack of conformity. Breakage, cracks and glaze defects are defects and are covered by complaints.

8. Out-of-court dispute resolution

  1. The alternative dispute resolution (ADR) entity competent for the Seller is the Dolnośląski Voivodeship Inspector of Trade Inspection in Wrocław, Poland (https://www.gov.pl/web/wiih-wroclaw). Proceedings are free of charge.
  2. The Seller is established in Poland, so the out-of-court schemes available for disputes with the Seller are the Polish ones, in particular: - the permanent consumer arbitration court at the Regional Inspectorate of Trade Inspection in Poland, - mediation before the Regional Inspector of Trade Inspection.
  3. If you live in another EU country, the European Consumer Centre network will help you pursue a cross-border complaint free of charge and will put you in touch with the Polish centre — https://www.eccnet.eu
  4. Use of these procedures is voluntary and requires the agreement of both parties.

Note: the European Online Dispute Resolution (ODR) platform was shut down on 20 July 2025 by Regulation (EU) 2024/3228. These Terms deliberately contain no link to it — directing consumers to an institution that no longer exists can itself be treated as misleading.

9. Personal data

The Seller is the controller of your personal data. How we process it, on what legal bases, for how long, and what rights you have are described in our Privacy Policy.

10. Final provisions

  1. These Terms and any Sales Contract are governed by Polish law.
  2. This choice of law does not deprive you, as a Consumer, of the protection afforded to you by the mandatory provisions of the law of your country of habitual residence (Article 6 of Regulation (EC) No 593/2008, "Rome I").
  3. We may amend these Terms for valid reasons — changes in law or in the available payment or delivery methods — giving 14 days' notice. Orders placed before a change takes effect are governed by the previous version.
  4. Nothing in these Terms limits your statutory rights as a Consumer. Where a provision conflicts with mandatory law, the law prevails.

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the last good. To exercise the right of withdrawal, you must inform us

of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or e-mail). You may use the attached model withdrawal form, but it is not obligatory.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

The deadline is met if you send back the goods before the period of 14 days has expired. You will have to bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
